Thank you for your interest in the Doggy Day Out program. The Doggy Day Out materials will be provided to you by Mutual Rescue, free of charge, as a sample kit. Mutual Rescue is a national animal welfare initiative, founded by Humane Society Silicon Valley. If you are acquiring the Doggy Day Out materials on behalf of an organization, these terms are between Mutual Rescue and the organization you represent. 1. By participating in the Doggy Day Out program, you agree to the following: You agree to indemnify, defend, and hold Humane Society Silicon Valley harmless from and against all claims and demands that may arise out of your participation and involvement in the Doggy Day Out program. 2. You warrant that: (a) you have the full authority to assent to these terms on behalf of the organization intending to participate in the Doggy Day Out Program; (b) this Waiver and Release has been duly authorized and approved by such organization; (c) this Waiver and Release constitutes a valid and binding obligation of such organization; and (d) you will not display, modify, transmit or otherwise use our logos, trade names, and trademarks without our prior written approval. 3. THE DOGGY DAY OUT SAMPLE KIT IS PROVIDED TO YOU “AS IS” AND WE MAKE NO OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS OF IMPLIED, STATUTORY OR OTHERWISE, ARISING OUT OF THESE TERMS OR IN CONNECTION WITH THE DOGGY DAY OUT PROGRAM. WE SPECIFICALLY DISCLAIM ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT WILL WE BE LIABLE FOR YOUR USE, SELECTION, IMPLEMENTATION, OR MODIFICATION OF THE DOGGY DAY OUT MATERIALS. 4. YOU HEREBY IRREVOCABLY RELEASE HUMANE SOCIETY SILICON VALLEY D/B/A MUTUAL RESCUE, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND VOLUNTEERS FROM ANY AND ALL CLAIMS YOU, YOUR EMPLOYEES, YOUR AGENTS, OR YOUR VOLUNTEERS MAY HAVE FOR PERSONAL INJURY, INCLUDING DEATH, AS WELL AS ALL PROPERTY DAMAGE OR LOSS, ARISING OUT OF YOUR PARTICIPATION IN THIS DOGGY DAY OUT PROGRAM.
